Les Conditions
Please read the following conditions carefully as participating in the festival acknowledges your agreement:
- By completing this Registration Form and submitting it, with the Producer’s film ( Film ), to 15/15 via your regional coordinator ( 15/15 ) by no later than 11pm on Filming Day, the Producer has applied to enter the Film in the 15/15 Film Festival ( Festival ) and related competitions and accepts that these Conditions of Entry create a binding agreement between 15/15 and the Producer.
- 15/15 may, in its absolute discretion, and without giving reasons, nominate the film for an award ( Nominated ), judge it to be a winning entry as awarded at the Gala Night ( Awarded ) or screen the film at one of the international destinations ( Screened ). Any prizes awarded are not transferable, replaceable or redeemable.
- The Producer makes the following guarantees to 15/15:
- the Film was made by the Producer specifically for the Festival;
- the Film complies with these Conditions of Entry;
- the Film has not been, and will not be prior to the Festival, available to be viewed by the public by any means, including by way of the internet;
- the rights (including the intellectual property rights) in the Film have not been, and will not be prior to the Festival, assigned or licensed to any party other than 15/15;
- the Producer is entitled to reproduce and exploit all of the underlying works in the Film by including these in the Film;
- without limiting clause 4(e), the Producer is the owner, or has permission from the owner, of the copyright in the sound recordings comprising the soundtrack to the Film and the music and lyrics reproduced in those sound recordings;
- all the performers in the Film have consented in writing to the use of their performances in the Film;
- the Producer has obtained from each contributor to the Film including the performers (Contributors) a written consent to their work being edited, altered and/or reproduced, in any manner or context, by the Producer, and any person authorised by the Producer to do so (including 15/15), and such consents have been obtained to the full extent permitted under the Copyright Act, 1968 (Moral Rights Consents);
- the Producer has obtained from each Contributor to the Film authorisation for 15/15 to use the Contributor’s name and likeness in connection with any publicity for the Festival and related competitions, and an undertaking that the Contributor will perform publicity appearances for the Festival and related competitions if reasonably requested by the Producer or 15/15;
- the Producer is entitled to grant to 15/15 permission to make use of each and every right referred to in clause 3 and the use or exploitation of the Film as contemplated by these Conditions of Entry will not violate the rights (including copyright) of any third party;
- all details in the Entry Form are true and correct, and the Producer indemnifies 15/15 against any and all claims and demands made against 15/15 in relation to the guarantees provided by the Producer in this clause 3 of these Conditions of Entry.
- Subject to clause 3, in consideration of 15/15 reviewing the Film for the purpose of the Film being Nominated, Awarded or Screened, the Producer grants an exclusive licence throughout the world in perpetuity to 15/15 (whether or not the Film is Nominated, Screened or Awarded) to do any and all of the acts now or subsequently comprising the copyright in the Film, including:
- all such acts in connection with any film festival conducted or participated in by 15/15;
- to include or embody the Film or any part of the Film in another film produced by 15/15 (or an assignee or licensee of 15/15) and in respect of which 15/15 (or its assignee or licensee) will own or be the licensee of any or all rights, being:
- a collection or compilation of films seen in public at any film festival conducted or participated in by 15/15; or
- a film comprising films, or parts of films, seen in public at any such film festival;
- to communicate the Film to the public by any media now existing or subsequently devised and by any means (including the Internet, commercial television, cable, satellite); and
- without limiting the generality of clause 4(c) above, to communicate the Film to the public by any means at, from or otherwise in connection with any film festival conducted by or participated in by 15/15.
- A Producer of a Film which is Nominated, Awarded or Screened may write to 15/15 after 1 July in the year after the year they submitted their film to request the termination of the exclusive licence granted to 15/15 under clause 4. If 15/15 reasonably considers, having regard to any arrangements or agreements that it has or may have with other parties in relation to the Film, that it no longer requires the exclusive licence granted under clause 4, it will terminate the exclusive licence and notify the Producer in writing, after which time neither 15/15 nor any assignee or licensee of 15/15 will have any rights, including copyright, in the Film. If 15/15 is not able to do so, it will not be in breach of the agreement created by these Conditions of Entry, and the exclusive licence will continue. 15/15 may also, at any time at its discretion, terminate the exclusive licence granted under clause 4 on giving written notice to the Producer. If the exclusive licence granted to 15/15 is terminated in accordance with this clause 5, 15/15 will make the Film available for collection by the Producer for a period of 30 days following 15/15’s notification of termination of the exclusive licence, after which time the Film may be disposed of by 15/15.
- Notwithstanding anything contained in these Conditions of Entry, the Producer must not grant any rights in the Film to any person:
- prior to the Festival; or
- where the grant of such rights would put 15/15 in breach of any agreement or arrangement made known to the Producer by 15/15 or of which the Producer ought to be aware.
- The producer acknowledges:
- that some 15/15 assignees or licensees may need to edit, alter or reproduce the Film and the Producer consents to these actions by 15/15 or any assignees or licensees of 15/15, in any manner or context, in perpetuity throughout the world. Such consent is given to the full extent permitted under the Copyright Act, 1968.
- that 15/15 is authorised to do any and all acts comprised in the Moral Rights Consents.
- The Producer authorises 15/15 to use the Producer’s name and likeness in connection with any publicity for the Festival and related competitions, and the Producer agrees to undertake publicity appearances for the Festival and related competitions as reasonably requested by 15/15.
- The agreement created by this Entry Form is made in Victoria, Australia, and is governed by the jurisdiction of the courts of Victoria. The Producer will do such acts and sign, or cause to be signed, such instruments as 15/15 may reasonably request for the purposes of this agreement. 15/15 may assign or license its interest under this agreement. The Producer must not assign or license its interest under this agreement. Where any party comprises more than one person, a reference to that party includes each such person severally and all such persons jointly. A reference to a person includes a body corporate. The singular includes the plural and vice versa. Includes and including are not words of limitation. The words and expressions used in this agreement have the meanings given to them in the Copyright Act, 1968 unless expressly stated to the contrary in this agreement. A reference to a “film” is a reference to a “cinematograph film”. In the case of any inconsistency between the provisions of these Conditions of Entry and any other language contained in this document, the provisions of these Conditions of Entry prevail.
